Ai Usage & Data Intelligence Policy
How we use artificial intelligence across the Platform
Effective Date: [TO BE FILLED IN]
Version 2.0 | Draft for Attorney Review
© Art Is Yummy, LLC. All rights reserved.
- Purpose
Art Is Yummy, LLC ("AIY") integrates artificial intelligence across the Platform to power creation tools, personalization, content discovery, safety systems, and analytics. This policy explains what AI we use, what data powers it, what rights you have, and how we handle AI-generated content. This policy supplements our Privacy Policy and is incorporated by reference into our Terms of Service.
- How We Use AI
2.1 Creation Tools (Synapse Station)
Synapse uses AI models to assist in generating audio, visual, text, and other creative outputs. When you use creation tools:
Your prompts, inputs, and preferences are sent to AI processing systems
AI outputs are generated based on trained models and your inputs
Creation session data (prompts, parameters, outputs) is logged for your personal history (Cortex) and Platform functionality
2.2 Personalization and Recommendations
We use AI and automated systems to personalize your experience, including: content recommendations in Discovery, Artist DNA-based matching, challenge suggestions, Marketplace surfacing, and feed curation. These systems analyze your activity patterns, preferences, and content interactions.
2.3 Content Moderation
Automated systems assist in identifying potentially violating content. No content removal decision is made solely by an automated system; human review is involved in enforcement actions.
2.4 Economy Monitoring
Automated systems monitor economy activity for anomalies, fraud patterns, and abuse. Flagged activity is reviewed by human operators before enforcement action.
2.5 Analytics and Insights
We use AI to analyze aggregate Platform usage patterns, feature performance, and user behavior trends. This analysis is performed on anonymized or aggregated data.
- AI Models and Providers
We use a combination of proprietary systems and third-party AI services. Current third-party AI providers include:
[TO BE FILLED IN: list of AI providers, e.g., Anthropic, OpenAI, Replicate, Suno, etc.]
When your data is processed by third-party AI providers, it is subject to our data processing agreements with those providers, which prohibit them from using your data to train their general models unless we explicitly permit it.
⚠ Confirm data processing agreements (DPAs) with all AI providers. Ensure none retain or train on user data outside the DPA scope.
- Training Data and Your Content
4.1 What We Train On
We may use the following data to improve our AI systems:
Anonymized and aggregated prompt patterns (not your specific prompts in identifiable form)
Aggregated generation quality metrics
De-identified usage patterns and interaction data
Public content you have published on the Platform (subject to your opt-out right below)
4.2 What We Do NOT Train On
Private, unpublished content in your Cortex or drafts
Direct messages or private communications
Content from users who have opted out of AI training
Payment information, authentication credentials, or sensitive personal data
4.3 Your Opt-Out Right
You may opt out of having your creation data used for AI training at any time through Player Portal > Settings > Privacy > AI Training Opt-Out. Opt-out takes effect within 30 days and applies prospectively. It does not affect anonymized data already incorporated into trained models, as extraction of individual contributions from trained models is not technically feasible.
- AI-Generated Content and Ownership
5.1 Copyright Considerations
The copyright status of AI-generated content is evolving. As of this policy's effective date:
Content with significant human creative input (selecting, arranging, editing AI outputs) may qualify for copyright protection
Content generated entirely by AI with minimal human input may not qualify for copyright protection in jurisdictions that require human authorship
AIY does not guarantee the copyrightability of any AI-assisted output
You are responsible for understanding the IP implications of content you publish or sell
5.2 Originality
AI models generate outputs based on patterns in training data. We do not guarantee that AI outputs are original, unique, or non-infringing. Other users using similar inputs may receive similar outputs. You are responsible for reviewing AI-generated content before publishing, selling, or distributing it.
5.3 License to AI Outputs
Subject to the limitations above, you may use AI-generated content created through the Platform for any lawful purpose, including commercial use through the Marketplace, provided you comply with the Terms of Service, this policy, and applicable law.
- Automated Decision-Making
Some Platform features involve automated decisions that affect your experience:
System
What It Affects
Human Oversight
Content recommendations
What you see in Discovery, feeds
Algorithm design and monitoring; no individual review
Content moderation
Content flagging and removal
Human review required for all enforcement actions
Economy monitoring
Fraud detection, suspicious activity flags
Human review before account-level actions
Marketplace surfacing
Listing visibility and ranking
Algorithm design; periodic manual audit
If you believe an automated decision has adversely affected you in a significant way, you may request human review by contacting [TO BE FILLED IN: support@artisyummy.com].
- EU AI Act Compliance
Where applicable, we are committed to compliance with the EU AI Act. Our creation tools and recommendation systems are not classified as high-risk AI systems under current guidelines. We maintain transparency about AI use as described in this policy and provide mechanisms for human oversight where required.
⚠ EU AI Act classification should be reviewed by counsel as regulatory guidance evolves. Creation tools that influence creative output may receive specific guidance.
- Changes
We update this policy as our AI capabilities evolve. Material changes (new data uses, new AI providers, changes to opt-out rights) are communicated via Platform notification and may require re-acknowledgment.
